Monitoring of the Procedure and Patent Maintenance
Each application is examined against specific requirements that, according to the regulations, it must meet. After filing the application, the Office will determine whether your application has been prepared in accordance with the regulations, and will invite you, if necessary, to eliminate the formal deficiencies. Also, during the procedure you will be asked to take further prescribed actions to continue the procedure.
It is very important that each invitation is answered within the specified period and according to the instructions in the act that was delivered to you, because otherwise the procedure conducted on your application will end with a decision to reject the application.
If during the patentability examination procedure it is established that your application does not fulfill the requirements for protection under the Patent Act, the Office will terminate the procedure by issuing a decision rejecting the application.
Before making a final decision on the rejection of the application, you will be given the opportunity to contest the reasons for the rejection stated by the examiner within a certain period of time. If you are lost in the area of industrial property rights, it is advisable to seek the help of professional representatives.
